SC Puts Hold On Controversial Order Of Bombay High Court


On January 19 the Bombay High Court gave away a controversial order where it said that the groping of a minor was “not sexual assault since there is no skin-to-skin contact.” The Supreme Court today put a hold on this order of the Bombay High Court as the Attorney General K K Venugopal said that the order would set a dangerous precedent.

The High Court said that under the Protection of Children from Sexual Offences (POCSO) Act, groping a minor breast without “skin-to-skin contact” cannot be termed as sexual assault. The judge of the Bombay High Court, Justice Pushpa Ganediwala said that there must be “skin to skin contact with sexual intent” to be considered as a sexual assault in an act and a mere groping cannot be defined as sexual assault.

The judge of the high court was ruling on the order of the lower court that had sentenced a 39-year old man for three years in jail for sexually assaulting a 12 year old girl
