Order issued by the Saket District Court !
Trademark infringement proceedings took place at different locations where around 400-500 tons of fake steel bars were found. According to the information, the steel bars cost rupees 5-6 crores.
This order was issued by the Saket District Court where a team from Delhi and Indore took action on the order of the District Court.
According to the information, this infringement was against Ganraj Ispat Private Limited for trademark infringement and which went to Ahmednagar, Maharashtra and Dewas, Madhya Pradesh.
According to the statement given by Sandeep Jain, the director of Moira TMT bars, “Moira Steel has been working since 1987 and the trademark is registered.”
The trademark Moira is also registered in about 32 classes of trademark. Similar to their trademark, Ganraj Ispat Private Limited is also manufacturing steel bars under the name of Bhoira TMT in Ahmednagar, Maharashtra, which looks similar to Moira TMT and is clearly infringing the registered trademark.
For this infringement, On August 2, 2022, the Advocate of Moira TMT,Bein Legal LLP, Ankur Tiwari, had filed a suit for trademark infringement for which the District Judge, Saket District Court, Delhi appointed Local Commissioners and ordered for search and seizure at Ganraj Ispat Private Limited located at Ahmednagar and at their dealers premise under the name of Naaz Dealers and Arbaaz Hardware which is located in Dewas, MP.
As per the information, August 10, 2022, the order of search and seizure was provided.
Further, the information mentions that the search was conducted in the case of trademark infringement by the team at different places in Ahmednagar and Dewas.
It was informed by the team that the trademark infringement was going on for a long duration.
During this procedure, Advocate Ankur Tiwari and Daksha Saraf from BeIN Legal LLP along with Shubham Jain and Yagvendra Verma from Moira Company were present in Ahmednagar, alongwith Advocate Ashish Vishwakarma, Khyati Tongia, Saloni Kasliwal, Pragati Dantre and Yashraj were present in Dewas on behalf of BeIN Legal LLP.
Also, the Moira Team, led by Mr. Gourav Sanghvi was present in Dewas during this procedure.
