Wife, not personal property, can't be forced to live with husband, says the Supreme Court.

A man had approached the Supreme Court of the country to issue an order for his wife to resume living with him. Hearing on this, the bench made this comment. The New Delhi Supreme Court has reiterated that women are not the personal property of anyone. The court said that the wife cannot be coerced and forced to live with her husband. The court made this remark during a hearing on Tuesday.

A man petitioned that the court order his wife to reside with him again. To this, a bench of Justice SK Kaul and Justice Hemant Gupta said, "What do you think? Is the woman a slave to someone that we will pass such an order? Is the wife's personal property that she can be instructed to go with you?" At the root of this whole controversy is an order for the restoration of marital rights, which was given by the Family Court of Gorakhpur in 2019. The woman said that since her marriage in 2013, her husband tortured her for dowry, the compulsion began to remain separate. In 2015, when she filed a case for alimony, the Gorakhpur court ordered her husband to pay her 20,000 rupees a month.

The husband then filed a petition in the family court for the restoration of the marriage rights. The court ruled in favor of the husband. The husband went to court again as soon as the Supreme Court decided to restore the marriage rights. This time his objection was about the payment of alimony, what about alimony when he is ready to live with his wife. The Allahabad High Court turned down his petition, after which he moved to the Supreme Court.

The husband repeatedly kept demanding this from the court in his defense, the woman said that this whole 'game' of the husband is to avoid paying alimony. The woman said that her husband went to the family court when he was ordered to do so. During the hearing on Tuesday, the husband's lawyer said that the Supreme Court should refuse his wife and send her back with him, especially after the family court has given a verdict in her favor. After repeated demands, the court had to say, "Is a woman a private property? Is the wife a slave? You are asking us to pass orders as if she can be sent to a place where she does not want to go, Like a slave. " The bench dismissed the petition to restore the marriage rights. In the year 2018, the top court also made a similar comment. Then a woman who complained of cruelty against her husband said that she does not want to live with her husband. Whereas the husband said that he wants to live with his wife
