Delhi HC dismisses CBI plea in case involving P Chidambaram

HC dismissed a plea by the CBI, Challenging an order of inspection


The HC on November 10, dismissed a plea made by the Central Bureau of Investigation, challenging an order that allowed inspection of documents in the INX Media case. The case is against former Minister P Chidambaram and his son Karti Chidambaram.


In 2017, the CBI had filed an FIR over alleged irregularities in the Foreign Investment Promotion Board (FIPB) clearance given to the INX Media group for receiving overseas funds of Rs 305 crore. P Chidambaram at that time was the Union finance minister in the UPA government.


The CBI had also said that INX Media had engaged a firm linked to Karti Chidambaram to resolve an issue with the IT Department and in turn received undue favour conditions.


The court on Wednesday heard CBI's challenge to a special court order in March allowing inspection of documents kept in the room where case related property is kept by P Chidambaram. The Court had ensured a fair trial, the CBI was required to file or produce all the documents collected or statements recorded by it during the investigation and that the accused are also bothered to copies of listed documents.


The CBI had challenged the special court order saying that the inspection of documents by the accused may turn in evidence tampering in Future.


According to Bar and Bench, one such grounds of CBI’s challenge was that the case involved a “high level of corruption” with “wide ramifications” for society. The central agency stated that as the accused had the fair right to a fair trial, the overall interest of society cannot be effected up
