SC to hear PIL on 24 Feb...


On 15 February 2023, the Supreme Court accepted to hear the PIL (Public Interest Litigation) seeking the attention of all the state governments to frame the rule of leave during the menstrual pain of 2 days for the female students and working class women to their workplace and school or university under Section 14 of the Maternity Benefit Act of 1961.

As per the information, a bench of judges headed by the Chief Justice of India, DY Chandrachud posted the whole information for hearing the PIL on 24 February 2023.

The matter came to light when advocate Shailendra Mani Tripathi mentioned the matter and asked for an early hearing of the case. He further stated that the Maternity Benefit Act of 1961 contains provisions for almost all the issues faced by the female employee for a specific number of days during pregnancy, miscarriage, or for tubectomy surgery, as well as in case of illness or medical complications that happened during the time of maternity leave.

Following the petition, Bihar is the only state that provide leave during the menstrual pain from 1992 through Human Resources.
