UP And UK Get Notice From SC To Review Validity Of Laws Over Illegal Convert.


The Supreme Court (SC) today issued legal notices to the states of Uttar Pradesh (UP) and Uttrakhand (UK) to examine the legal validities of the laws against unlawful conversions. In response to a bunch of petitions which had challenged the validity of the law came the decision the decision of the court when the petitioners argued that new formed laws disturb the basic structure of the Constitution and have demanded to strike down the laws as they are violating secularism, equality and non-discrimination.

The Chief Justice of India (CJI) SA Bobde said “we are issuing notice” and added that the matter would be examined after four weeks. The court was reluctant in the initial to address the issue and had asked the petitioners to move to the High Courts. The senior counsel CU Singh who was the presenter of the petitioner Citizens for Justice and Peace (CJP) said in response to the court that the matter should be looked into by the top courts as “multiple states are passing these laws.”

The law is an ‘illusory construct’ which is based on a discourse to promote a split in the society, generate a suspicious attitude towards Islam and the Islamic communities  and  create hatred among communities and disturb the harmony is what was mentioned in one of the pleas. The petitions also raised issues over privacy and providing immoderate constitutional powers to the police.

The Prohibition of Unlawful Conversion of Religion Ordinance 2020 in the state of Uttar Pradesh and the Freedom Of Religion Act, 2018 in Uttarakhand state prohibits the conversion for marriage purposes.
